
Though Apple released a solution for fixing the iMessage issue but still it seems Apple
will have to face a lawsuit by Adrienne Moore the former user of iPhone. In the
lawsuit, it claims that Apple didn’t inform its customers about the iMessage issue. They should have told
customers that iMessage will stop delivery of messages from other iOS users if
the customer changes to another platform like Android or Windows phone.
iMessage was introduced in 2011, its purpose is to allow
users to send text messages via Wi-Fi and Data networks instead of telecom
networks. For this reason they keep track of the user’s mobile number. However,
when a user changes to another platform with changing their number, they will
not receive iMessages on their current device instead it will be sent to their
previous iPhone device. Moore also faced this problem when she changed from
iPhone to Samsung Galaxy S5 with her same Verizon contract. According to her,
this caused a disruption in her wireless service contract and ended up
violating California unfair competition law.
US District judge also believes that Moore should get a
chance to prove herself. Koh said "Plaintiff does not have to allege an
absolute right to receive every text message in order to allege that Apple's
intentional acts have caused an actual breach or disruption of the contractual
relationship".
Apple replied, that they never claimed that iMessage will
have the ability to recognize when the user will change from one platform to
another. Apple said "Apple takes customer satisfaction extremely
seriously, but the law does not provide a remedy when, as here, technology
simply does not function as plaintiff subjectively believes it should".
